1. Acceptance of Terms

By accessing and using Monotone ("the Service", "we", "us", or "our"), you accept and agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service.

These Terms constitute a legally binding agreement between you and Monotone Inc. Your use of the Service constitutes your acceptance of these Terms and our Privacy Policy.

2. Description of Service

Monotone is an AI-powered storytelling and interactive fiction platform that generates fictional characters, dialogue, scenarios, images, and narratives ("Generated Content") based on user inputs ("Prompts").

IMPORTANT DISCLAIMER: The AI characters, dialogue, scenarios, images, and all other content generated by the Service are entirely fictional and created by artificial intelligence. They are not real people, real events, or real advice. The Service is provided solely for entertainment and creative storytelling purposes.

The Service does not provide medical, psychological, therapeutic, relationship, legal, financial, or any other form of professional advice. Any information or suggestions provided by the AI are fictional and should not be relied upon for any real-world decisions. Reliance on any Generated Content is solely at your own risk.

3. User Eligibility

You must be at least 18 years old to use this Service. By using the Service, you represent and warrant that you are at least 18 years of age and have the legal capacity to enter into these Terms.

4. User-Generated Content and Prohibited Use

You are solely responsible for the Prompts you input and the Generated Content you create. You acknowledge and agree that you bear all risks associated with your use of the Service.

You agree NOT to use the Service to generate, create, distribute, or attempt to generate any content that:

  • Depicts, promotes, or involves child sexual abuse material (CSAM) or child exploitation in any form
  • Depicts or promotes non-consensual sexual content, including rape, sexual assault, or sexual violence
  • Depicts or promotes human trafficking, sexual slavery, or forced prostitution
  • Is illegal under United States federal law or the laws of your jurisdiction
  • Violates intellectual property rights, including copyright, trademark, or patent infringement
  • Contains malware, viruses, or any code designed to harm or exploit systems
  • Impersonates any person or entity, or falsely states or misrepresents your affiliation with a person or entity
  • Harasses, threatens, or promotes violence against any individual or group based on race, ethnicity, national origin, religion, gender, gender identity, sexual orientation, disability, or age
  • Interferes with or disrupts the Service or servers or networks connected to the Service
  • Attempts to gain unauthorized access to any portion of the Service or any other systems or networks
  • Promotes illegal activity, including illegal gambling, money laundering, or the sale of illegal drugs or substances

We reserve the right to immediately terminate your account and ban you from the Service, without refund, if you violate these prohibited use policies. We may also report illegal activity to law enforcement authorities.

We employ automated systems and manual review to detect violations of these policies. While we make reasonable efforts to prevent prohibited content, we cannot guarantee that all violations will be detected. You agree to report any violations you encounter to support@monotone.fyi.

5. Intellectual Property Rights

The Service, including its software, algorithms, user interface, design, and underlying technology, is owned by Monotone Inc. and protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property laws.

Restrictions: You may not:

  • Reverse engineer, decompile, disassemble, or attempt to derive the source code of the Service
  • Use the Service to develop, train, or improve a competing AI model or service
  • Scrape, extract, or harvest Prompts, Generated Content, or any data from the Service using automated means (including bots, scrapers, or crawlers)
  • Remove, obscure, or alter any copyright, trademark, or other proprietary rights notices
  • Use the Service in any manner that could damage, disable, overburden, or impair our servers or networks

Your Content: You retain ownership of your Prompts. By using the Service, you grant us a worldwide, non-exclusive, royalty-free license to use, store, and process your Prompts solely to provide the Service to you and to improve the Service. Generated Content created by the AI may be subject to copyright limitations. We do not claim ownership of your Prompts or Generated Content.

6. Subscriptions and Payments

Monotone offers subscription-based access to the Service. By subscribing, you agree to pay all fees associated with your selected subscription plan.

Billing: Subscription fees are billed in advance on a recurring basis (monthly or annually, depending on your plan). You authorize us to charge your payment method on file for all fees.

No Refunds: All purchases are final. We do not offer refunds for partial subscription periods, unused credits, or dissatisfaction with the Service. If you are unsatisfied with the Service, you may cancel your subscription at any time to prevent future billing, but you will not receive a refund for the current billing period.

Cancellation: You may cancel your subscription at any time through your account settings. Cancellation will take effect at the end of your current billing period. You will retain access to the Service until the end of the paid period.

Price Changes: We reserve the right to change subscription pricing at any time. If we increase the price of your subscription, we will notify you at least 30 days before the change takes effect. Your continued use of the Service after the price change constitutes acceptance of the new price.

Chargebacks: If you initiate a chargeback or payment dispute, we reserve the right to immediately terminate your account and ban you from future use of the Service.

7. Account Termination

We reserve the right to suspend or terminate your account and access to the Service at any time, with or without cause, with or without notice, effective immediately. Reasons for termination may include, but are not limited to:

  • Violation of these Terms of Service
  • Generation of prohibited content
  • Fraudulent or abusive activity
  • Chargebacks or payment disputes
  • Prolonged inactivity

Upon termination, your right to use the Service will immediately cease. We may delete your account and all associated data. We are not liable to you or any third party for any termination of your access to the Service.

You may delete your account at any time through account settings. Upon deletion, all your data will be permanently removed from our servers in accordance with our Privacy Policy.

8. Disclaimers and Limitations of Liability

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

  • The Service will be uninterrupted, secure, or error-free
  • The results or output from the Service will be accurate, reliable, or suitable for your purposes
  • Any errors or defects in the Service will be corrected
  • The Service will meet your requirements or expectations

You acknowledge that AI-generated content may contain errors, biases, offensive material, or inaccuracies. We are not responsible for the quality, accuracy, or appropriateness of Generated Content.

LIMITATION OF LIABILITY: TO THE MAXIMUM EXTENT PERMITTED BY LAW, MONOTONE INC., ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

  • Your use or inability to use the Service
  • Any unauthorized access to or use of our servers or any personal information stored therein
  • Any interruption or cessation of the Service
  • Any bugs, viruses, or other harmful code transmitted through the Service
  • Any errors or omissions in Generated Content
  • Any reliance on Generated Content

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES, AND CAUSES OF ACTION EXCEED THE AMOUNT YOU HAVE PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

9. Indemnification

You agree to indemnify, defend, and hold harmless Monotone Inc., its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including attorney's fees) arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your Prompts or Generated Content
  • Your violation of any rights of another person or entity
  • Your violation of any applicable laws or regulations

10. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware and the United States of America, without regard to conflict of law principles.

Arbitration Agreement: Any dispute, controversy, or claim arising out of or relating to these Terms or the Service shall be resolved by binding arbitration in accordance with the American Arbitration Association's Commercial Arbitration Rules. The arbitration shall be conducted in Delaware, and judgment on the arbitration award may be entered in any court having jurisdiction.

Class Action Waiver: You agree that any arbitration or proceeding shall be limited to the dispute between you and us individually. You waive any right to participate in a class action, class arbitration, or any other representative proceeding.

11. Changes to Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by email or by posting a notice on the Service at least 30 days before the changes take effect.

Your continued use of the Service after the effective date of the revised Terms constitutes your acceptance of the changes. If you do not agree to the revised Terms, you must stop using the Service and cancel your subscription.

12. Severability

If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision shall be deemed severable from these Terms and shall not affect the validity and enforceability of the remaining provisions.

13. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Monotone Inc. regarding the Service and supersede all prior agreements and understandings, whether written or oral.
